shep Posted April 1, 2015 Report Share Posted April 1, 2015 So got a call about a shop who dropped my bike today. I have a custom paint job thats faded or changes shades in certain areas. The shop believes they know a painter who can replicate the look of the current paint. I dont know about paint so what do you guys think? Is it possible or is it going to be incredibly noticeable? Also cracked the stator cover and is leaking oil along with a few other scratches all of which they said they would fix. Never experienced this issue, should i allow them to fix or try to fix the mistake or call insurance. Also are they legally liable for the damage because they stated due to ohio law they are not responsible for any damages they caused when I signed for them to change my tires???Any info would be great. My old vmax had a candy blue marble finish and attackpainter managed to match it when I cracked my fender.. Paint was like 13yrs old at that point and done by somebody else... So it is possible, just not sure I'd trust just anyone... I'd call the dealership and try to find out who their painter is and go from there... As far as calling insurance, I'd wait and see what they say.. If they offer to fix it and have a reputable painter, I'd let them handle it before going to the insurance company and opening a claim... A lot of times people and companies will act their best when they know it's in their best interest. If they come out smelling like a reputable rose on this, be sure the rest of us know exactly who they are - the world needs more shops willing to do the right thing. As long as it's an actual shop and not a guy in his garage they'll have insurance. They very much are 100% liable for damages to your motorcycle. They should research the concept of "bailment" before telling you they aren't responsible. you can still sign-away your right to sue them, but it would be a PR nightmare for them to handle something like this poorly. The shop should be apologizing and begging you to make sure it's fixed to your satisfaction, then apologize again for having your bike in their possession longer than you anticipated. HomeSlice Posted April 2, 2015 Report Share Posted April 2, 2015 I had a ford dealer wreck my car while it was there for maintenance- If I were you I would go take photos, pick up the bike, have your insurance company write up an estimate and have the shop cut a check. If they don't pay, I would have my attorney write up a letter. They tried to fix your bike once and look what happened.... what makes you think they would do a better job the second time?? shep Posted April 2, 2015 Author Report Share Posted April 2, 2015 Yeah, as many have mentioned above they should be working proactively to right this wrong, im working with the owner to try and get this figured out, today i was suppose to get a call from them telling me what the time scale will be like for tim to paint the fairing but have yet to get a response.The original job was for tires, then they found out my rear hub bearing was loose so they charged me $360 (parts) on top of the tires to fix it, stated sense they had the tire off already they wouldnt charge me labor to install the new one but they added an hour charge... the original timeline for that job was 3 to 5 days, didnt get that done until 10 days later, i understand being busy or delay on parts but double the quoted time scale without contacting me and a false charge from what they stated on the phone. Ill keep everyone posted, id love for this to end good for both parties and not cause bad PR to this shop but this process is getting a little rediculous ...thanks for the info everyone Quote Link to comment Share on other sites More sharing options...

Pick up the bike, call your insurance, let them go after the dealership... You can take bike to attackpainter and he'll fix it up perfectly. It is actually called unintentional tort and you do have legal grounds to file a civil suit and having a police report would give you more than enough grounding to take that action if needed. The guy does that kind of work and Mike vouches for him. Let them fix the bike, if it isn't acceptable when you go there tell them...don't accept it. shep Posted April 2, 2015 Author Report Share Posted April 2, 2015 Yeah i dont want to involve insurance or police if its not needed and they are willing to correct the issue which it seems as if they are but i just wanted to make sure someone in the columbus area knew who this guy was, all the custom paint shops i went to or called have never heard of him before so it was a bit frustrating. I found his work online and it looks good but sense this is a new situation to me i was curious on opinions.
